1. Introduction & Scope
This Privacy Policy ("Policy") describes how That’s A Nice Car LLC ("TANC," "we," "us," or "our") collects, uses, retains, discloses, and otherwise processes personal information in connection with your access to and use of the website located at thatsanicecar.com, all related subdomains, applications, tools, features, and services (collectively, the "Site" and "Services"). This Policy applies to all users of the Site, including registered buyers and sellers, casual browsers, newsletter subscribers, and any other person who provides personal information to TANC in any manner.
This Policy is incorporated by reference into, and forms part of, TANC’s Terms of Service. By accessing or using the Site or Services in any manner, you acknowledge that you have read, understand, and agree to the practices described in this Policy. If you do not agree with any part of this Policy, do not use the Site or Services.
TANC is a technology platform and marketplace intermediary. TANC is not a party to any vehicle purchase or sale transaction. This Policy does not apply to the independent privacy practices of buyers, sellers, or third-party service providers (escrow agents, vehicle transporters, inspectors, photographers, etc.) who are separate legal entities.
2. Information We Collect
2.1 Information You Provide Directly
- Registration information: name, email address, postal address, city, state, ZIP code, telephone number, username, and password.
- Seller listing information: vehicle make, model, year, mileage, VIN, paint color, interior color, condition description, photographs, and any supplemental content you submit.
- Buyer offer information: the six structured offer criteria you submit (price, deposit amount, source of funds, method of payment, time to acquire, method of acquisition).
- Contact and communications: messages you send via the Contact Seller function, comments you post on listing pages, correspondence with TANC customer service, and feedback you provide.
- Payment information: when you purchase the optional professional photography package or pay TANC’s buyer fee at closing, we collect billing information including credit card details, billing name, and billing address. Payment processing is handled by PCI-compliant third-party payment processors; TANC does not store full card numbers on its servers.
- Identity verification information: government-issued identification or other verification documents we may request in connection with high-value transactions or account security.
- Referral and affiliate information: if you participate in a referral or affiliate program, we collect information about referred parties and qualifying transactions.
- Waitlist and newsletter information: name, email address, and buyer/seller designation collected through our waitlist signup, newsletter subscription, and lead capture forms.
2.2 Information We Collect Automatically
- Log data: IP address, browser type and version, operating system, device type, device identifiers, referring URLs, pages visited, time spent on pages, links clicked, and date/time stamps.
- Cookies and similar technologies: session cookies, persistent cookies, pixel tags, web beacons, local shared objects (Flash cookies), and similar tracking technologies. See Section 7 for details.
- Usage data: search queries, listings viewed, offers viewed, filters applied, and other interactions with the Site and its features.
- Location data: approximate geographic location inferred from your IP address; precise location only if you expressly grant location permission through your browser or device.
- Device and technical data: hardware model, mobile network information, screen resolution, time zone, language preferences, and installed font types.
2.3 Information We Receive from Third Parties
- Third-party login and social media providers: if you authenticate using Google, Facebook, or another third-party service, we receive profile information in accordance with your privacy settings on that service.
- Analytics and advertising partners: data management platforms, analytics providers, and advertising networks may share audience data, conversion signals, and behavioral data with us.

3. How We Use Your Information
TANC uses personal information for the following business and commercial purposes:
3.1 Platform Operations
- Creating, maintaining, and securing your TANC account
- Processing and publishing vehicle listings submitted by sellers
- Receiving, displaying, and managing buyer offers
- Connecting buyers and sellers through the Contact Seller function and Dashboard
- Facilitating buyer fee collection, optional photography package transactions, and post-acceptance closing services
- Coordinating escrow, title verification, inspection assistance, and vehicle transportation through third-party providers
- Sending transactional emails and notifications regarding your listings, offers, and account activity
3.2 Marketing, Advertising, and Communications
- Sending you The Exchange Report newsletter, listing alerts, market reports, and other promotional content about TANC and its services
- Personalizing content, recommendations, and advertisements based on your browsing behavior, offer history, and inferred preferences
- Conducting targeted and retargeted digital advertising across Meta (Facebook and Instagram), Google, YouTube, LinkedIn, TikTok, and other advertising platforms
- Sharing audience segments, email lists, hashed email addresses, and behavioral data with advertising platforms for lookalike audience creation and campaign optimization
- Contacting you about events, partnerships, sponsorships, and marketing opportunities
- Soliciting feedback, reviews, testimonials, and participation in surveys or research
3.3 Analytics, Research, and Product Improvement
- Analyzing usage patterns, traffic sources, conversion rates, and user behavior to improve the Site and Services
- Conducting market research and competitive analysis
- Developing new features, products, and services
- Training and improving internal systems, including any machine learning or artificial intelligence tools
3.4 Safety, Security, and Legal Compliance
- Detecting and preventing fraud, abuse, unauthorized access, and other harmful activity

- Enforcing our Terms of Service and other applicable policies

- Protecting the rights, property, and safety of TANC, its owners, employees, agents, users, and the public
- Establishing, exercising, or defending legal claims
3.5 Business Transactions
We may use your personal information in connection with a merger, acquisition, asset sale, financing, reorganization, bankruptcy, or similar business transaction involving all or part of TANC. In such event, your personal information may be transferred to one or more successors in interest, subject to reasonable confidentiality obligations.
4. How We Share and Disclose Your Information
TANC may share your personal information in the following circumstances. By using the Site, you consent to these disclosures.
4.1 Other Users of the Platform
- When you use the Contact Seller function, the seller receives your name, email address, and any information you include in your message.
- When you submit a buyer offer, the content of your offer (all six criteria) is visible to the seller and, upon submission, to other registered buyers viewing the same listing on their private Dashboard, consistent with TANC’s transparent offer model.
- Your username and any content you post in listing comments are visible to all Site users, registered or unregistered.
4.2 Service Providers and Vendors
We share personal information with third-party vendors and service providers that perform services on our behalf, including but not limited to:
- Website hosting, cloud infrastructure, and content delivery networks
- Payment processors and fraud prevention services
- Email marketing, CRM, and marketing automation platforms
- Analytics and business intelligence providers (including Google Analytics and similar services)
- Advertising platforms and ad networks
- Customer support tools and helpdesk software
- Car history report providers
- Escrow service providers
- Vehicle inspection services
- Vehicle transportation and logistics providers
- Professional photography services
- Identity and document verification services
- Cybersecurity and fraud detection vendors
These service providers are authorized to use your personal information only as necessary to perform services for TANC.
4.3 Sellers and Vehicle-Related Parties
With your express consent, TANC may share your personal information with vehicle sellers, manufacturers, dealerships, or affiliated businesses who may use that information to respond to your inquiries, fulfill your requests, or market their products and services to you. Once shared, that information is subject to the recipient’s own privacy policy.
4.4 Marketing, Advertising, and Analytics Partners
TANC shares personal information and audience data with digital advertising platforms, data management platforms, and analytics partners including Meta, Google, LinkedIn, TikTok, and others. This sharing enables targeted and retargeted advertising, campaign measurement, lookalike audience creation, and audience optimization. This sharing may constitute a "sale" or "sharing" of personal information under California law; see Section 9 for your opt-out rights.
4.5 Strategic Partners and Community Organizations
We may share your personal information with strategic partners such as Fast Lane Drive, luxury car clubs, private aviation brokers, wealth management advisors, luxury lifestyle brands, and other organizations whose services are complementary to TANC’s marketplace. Any such sharing requires your consent where required by applicable law. Shared information is subject to the partner’s own privacy policy.
4.6 Corporate Affiliates
We may share your personal information with TANC’s current and future corporate affiliates and subsidiaries, which will use it in accordance with their own privacy policies or this Policy.
4.7 Legal and Regulatory Disclosures
We disclose personal information when required by law, court order, subpoena, legal process, or government authority; when necessary to protect the rights, property, or safety of TANC, its users, or the public; or when we believe in good faith that disclosure is necessary to detect, prevent, or address fraud, security, or technical issues.
4.8 Business Transfers
Personal information may be transferred as part of a merger, acquisition, asset sale, financing, restructuring, or bankruptcy proceeding. We will provide notice of such transfer as required by applicable law.
4.9 With Your Consent
We may share your personal information for any other purpose with your prior express consent.
5. Data Retention
TANC retains personal information for as long as necessary to fulfill the purposes described in this Policy, including for the duration of your account relationship with TANC and thereafter as follows:
- Account information is retained for the duration of your registered account plus a minimum of seven (7) years following account closure, to satisfy legal, regulatory, tax, and audit obligations.
- Listing and offer records are retained indefinitely as part of TANC’s transaction archive and marketplace history, which constitutes a legitimate business record and market intelligence asset.
- Transaction records (including completed sale records, fee collection records, and escrow coordination records) are retained for a minimum of seven (7) years following the transaction date.
- Marketing and communications data (email addresses, communication preferences, and engagement history) are retained until you opt out or request deletion, subject to the retention obligations described above.
- Log data and usage analytics are retained for a minimum of two (2) years.
- Backup and archive copies of data may be retained for additional periods as required for system integrity, disaster recovery, and operational continuity.
Retention periods may be extended where required by applicable law, regulatory guidance, litigation hold, or legal dispute. TANC exercises its discretion to retain data for longer periods where it has a legitimate business, legal, or operational reason to do so, consistent with California law.
6. Data Security
TANC has implemented commercially reasonable administrative, technical, personnel, and physical security measures designed to protect personal information against loss, theft, unauthorized access, disclosure, modification, and destruction. These measures include, without limitation: encrypted data transmission (TLS/SSL), password hashing, access controls and role-based permissions, login audit logging, idle session termination, firewall protection, and periodic security assessments.
Despite our efforts, no security system is impenetrable, and TANC cannot guarantee the absolute security of personal information. By using the Site, you acknowledge and accept this inherent risk. TANC is not responsible for the security practices of third-party service providers, partner organizations, or other users of the platform. Buyers and sellers are independently responsible for protecting their own credentials and for the security of any communications they initiate outside of the TANC platform.
7. Cookies, Tracking Technologies, and Online Advertising
7.1 Types of Technologies We Use
- Session cookies: temporary cookies that expire when you close your browser, used to manage your login session and shopping cart.
- Persistent cookies: cookies that remain on your device between sessions, used to remember your preferences and recognize returning users.
- Pixel tags and web beacons: small graphic images embedded in emails and web pages that allow us to track email opens, page visits, and ad impressions.
- Local shared objects (Flash cookies): used to store preferences and track usage; may be controlled through your Flash settings.
- Device fingerprinting: collection of device attributes (browser type, plugins, screen resolution, fonts, IP address) to identify and recognize devices across sessions.
- Third-party tracking technologies: analytics, advertising, and social media platforms (including Google Analytics, Meta Pixel, LinkedIn Insight Tag, TikTok Pixel, and others) place their own cookies and tracking technologies on our Site.

7.3 Your Cookie Choices
Most browsers allow you to refuse or delete cookies through browser settings. Opting out of cookies may impair certain functionality of the Site. You may also opt out of interest-based advertising through the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and individual platform settings (Google Ads Settings, Meta Ad Preferences, LinkedIn Ad Settings, TikTok Ads). Opting out of advertising cookies does not opt you out of all data collection.
For California residents, certain uses of tracking technologies may constitute a "sale" or "sharing" of personal information. See Section 9 for opt-out rights.
8. Children's Privacy
The Site and Services are intended solely for users who are 18 years of age or older. TANC does not knowingly collect personal information from individuals under 18. If we learn that we have collected personal information from a person under 18, we will delete it promptly. 9. California Privacy Rights (CCPA/CPRA)
This Section applies to residents of California and supplements the rest of this Policy. TANC complies with the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020, as amended and implemented by the California Privacy Protection Agency (collectively, "CPRA").
9.1 Categories of Personal Information Collected
In the preceding 12 months, TANC has collected the following categories of personal information as defined by the CPRA:
- Identifiers (name, email, IP address, account username, device ID)
- California Customer Records categories (address, telephone number, financial information)
- Protected classification characteristics (age, if provided)
- Commercial information (vehicle listing data, purchase and transaction history, offer history)
- Internet or other network activity (browsing behavior, search history, Site interaction data)
- Geolocation data (approximate location from IP address)
- Professional or employment-related information (voluntarily provided)
- Inferences drawn from personal information (preferences, interests, behavioral profiles)
- Sensitive personal information: financial account and payment card information (collected and processed for payment purposes only)
9.2 Purposes for Collection and Use
Personal information is collected and used for the business and commercial purposes described in Section 3 of this Policy.
9.3 Sale and Sharing of Personal Information
TANC may "sell" or "share" (as those terms are defined under California law) certain categories of personal information — including identifiers, internet activity data, and inferences — with advertising partners, analytics providers, and data management platforms for the purpose of delivering targeted advertising. We do not knowingly sell or share personal information of individuals under 16.
9.4 Your California Privacy Rights
California residents have the following rights under the CPRA, which TANC will honor subject to identity verification and applicable exemptions:
- Right to Know: the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which it was used, and the categories of third parties with whom it was shared.
- Right to Delete: the right to request deletion of personal information we have collected from you, subject to exceptions including information needed to complete transactions, detect fraud, comply with legal obligations, or exercise legal rights.
- Right to Correct: the right to request correction of inaccurate personal information we maintain about you.
- Right to Opt Out of Sale/Sharing: the right to direct TANC not to sell or share your personal information with third parties for cross-context behavioral advertising. To exercise this right, click the "Do Not Sell or Share My Personal Information" link in the footer of our Site, or contact us at CustomerService@TANC.com.
- Right to Limit Use of Sensitive Personal Information: the right to direct TANC to limit its use and disclosure of sensitive personal information to the purposes necessary to provide you with the requested services.
- Right to Non-Discrimination: the right not to receive discriminatory treatment for exercising your CPRA rights. TANC will not deny you services, charge you different prices, or provide a different quality of service because you exercised a CPRA right.
- Right to Data Portability: the right to receive, in a structured, machine-readable format, the personal information you have provided to TANC, to the extent technically feasible.
9.5 How to Submit a California Privacy Request
To exercise your California privacy rights, submit a request to us by:

We will acknowledge receipt of your request within 10 business days and respond within 45 calendar days (extendable by an additional 45 days if reasonably necessary, with prior notice). We may verify your identity before processing your request.
9.6 Authorized Agents
California residents may designate an authorized agent to submit privacy requests on their behalf by providing the agent with written authorization and verifying the agent’s authority with TANC directly.
10. Third-Party Websites and Links
The Site may contain links to third-party websites, social media platforms, escrow services, vehicle inspection services, transportation providers, and other external resources. TANC is not responsible for the privacy practices, content, or security of any third-party website or service. We strongly encourage you to review the privacy policy of every third-party website you visit before providing any personal information. This Policy applies only to information collected by TANC on the Site.
11. Social Media Widgets and Integrations
The Site displays social media widgets from platforms including Instagram, Facebook, YouTube, TikTok, and LinkedIn. These widgets may allow the social media platforms to collect information about you even when you do not explicitly interact with the widget. Each social media platform’s privacy policy controls the collection, use, and disclosure of information transmitted to that platform. TANC does not control and is not responsible for third-party data collection through social media integrations.
12. Email Communications and Opt-Out
TANC sends the following types of email communications:
- Transactional emails: account confirmation, offer notifications, listing status updates, fee collection confirmations, and post-acceptance escrow coordination. You cannot opt out of transactional emails while you maintain an active account.
- Marketing emails: The Exchange Report newsletter, listing alerts, market reports, promotional content, and partner announcements. You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting CustomerService@TANC.com.
Please allow up to 10 business days for opt-out requests to take effect. Opting out of marketing emails does not affect transactional communications.
13. Changes to This Policy
TANC reserves the right to modify this Policy at any time. Changes become effective upon posting the revised Policy on the Site, with the updated Effective Date noted at the top. We may (but are not obligated to) provide additional notice of material changes via email or a prominent notice on the Site. Your continued use of the Site after the effective date of any modification constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
